Driver involved in fatal collision with bicyclist Jose Rincon faces charge of 2nd degree murder

This article in the Arizona Daily Star reports that Glenda Rumsey, 42, is likely to be charged with 2nd degree murder for the death of 14 year old bicyclist Jose Rincon. Erik believes that this statute describes why she can be charged with 2nd degree:
Arizona Revised Statutes 13-1104(a)(3). Under circumstances manifesting extreme indifference to human life, the person recklessly engages in conduct that creates a grave risk of death and thereby causes the death of another person.
