It is difficult for me that a retired air force pilot would make such an error in judgement and making a lane change. Although I do not have enough facts, I do believe the police may have this one wrong. How can a driver with impaired judgement not be at fault? I am disappointed at the prosecution not taking the case further. This was not just an accident. A person chose to impaired while driving and struck and killed a human being. Justice was not served in my opinion.

My prayers go out to all involved. I especially hope this woman seriously makes a life change.

@dan. Arizona has no such thing as “felony vehicular homicide”. It is simply up to the county prosecutor to bring appropriate charges. here is a rundown of types of homicide in Arizona http://azbikelaw.org/carlaw/homicide.html
So the standard answer is the prosecutor didn’t believe it could proven that the driver was “criminally negligent” or “recklessly disregarded…” necessary to support a charge of Negligent HOmicide, or manslaugher, respectively.
Prosceutors are generally not hesitent to bring these charges in a DUI; e.g. in 2009 of the 25 cyclist fatalities in Arizona, there were 5 apparent DUIs, all of which led to Homicide charges. see

Since when is running a person down from behind not felony vehicular homicide? Does the local constabulary have holes in their G-D heads? Anybody thought to contact the State AG regarding this malfeasance?

I was Charles younger bother’s college roommate and knew Charles. He served his country with honor, he loved his family, and although as a fighter pilot asked to put his life on the line for ALL OF US, he did not take risks. He rode this path often and I am aware there had been concerns over careless vehicular traffic. This is truly wrong. Someone who is high on anything needs to be punished…it was homocide and she got a pass.

Just ring up Dean Kamen and ask for a donated Segway, and talk to the owner of the property about placing a memorial on his property.
Although you are clearly being sarcastic, really ghost bikes are no different than any other roadside memorial. People are killed in cars and on foot and frequently have roadside memorials as well. The ghost bike thing is intended to serve as a both a memorial and a warning to drivers to be more careful. If you are concerned about Segway safety awareness I am sure you could follow with similar memorial.

My condolences to the Nydstrom family. The sentence was a slap on the hand to the murderer driving the car, and a slap on the face of the victim’s family.

My friend was struck on the street while crossing it on his Segway. My question for the bike lawyer. Near this incident, can I anchor a “ghost” Segway on property I do not own, for an undetermined amount of time? Or is only an exception to bicycle memorials? And if you can, tell me where one might purchase one. Thank you
