Glenda Rumsey driving again

Glenda Rumsey, killer of Jose Rincon Jr., is back on the streets again. Her attorney told the judge that Rumsey “needs to be able to drive.” I guess if anyone has reason to know how dangerous riding a bicycle on Tucson’s streets can be, it’s Glenda Rumsey.

    The best thing a judge can do here is make her ride a bicycle everywhere she needs to go.

    And I knew this road-widening nonsense was going to be used as an excuse as soon as someone – I’m guessing either Rumsey herself or a member of her family – posted it here in a comment to an earlier blog entry. Since when did the roads not being wide enough to accomodate drunk driving serve as an excuse for same?

    Suspended licenses for DUI’s are a freaking joke. One of my relatives got in an accident while under the influence and was cited for DUI. Luckily, I don’t think anyone was hurt. Like two weeks later she earned the right to drive “solely to and from work.” Honestly, I don’t think she ever did stop driving. I definitely remember her driving two states over to visit my family while her license was suspended without incident.

    I understand that normal people get DUI’s driving home when they feel a bit buzzed, but 3X the limit is a bit much for a slap on the wrist. How many people do you have to murder before they actually take your license away?

    In my not-so-humble opinion, our DUI laws need to be more like Europe’s. Over there, you get the book thrown at you.

    One of my best friends was killed while cycling by a drunk driver on Silverbell in the Continental Ranch area. The driver had a long history of DUI’s and other drug arrests.

    The driver only served a few days in jail and some community service. It turned out she was an informant for the Marana Police Dept–at least that’s what we were told. We were also told the Marana Police Dept. “lost” the results of her breath test and other tests–she was stoned, and intoxicated, and going on a beer run when she hit and killed Megan. Without the evidence of the results, there was no real case and it ending badly and friends and family were shocked by the indiffernt attitude of the legal system.

    The fucking judge had the nerve to say “What do you think you people were doing out there riding your bikes anyway?” Like, drunk drivers have more rights than pedestrians and cyclists?

    The woman that killed our friend is still on the streets driving–

    Sorry for the rant–I just don’t get why they let these people have the right to drive back after what they’ve done.

    WELL SCOTT I GUESS YO DO NOT LIVE IN THE AREA WERE THE ACCIDENT HAPPENED. IF YOU DID YOU WOULD KNOW HOW THE ROAD GOES.THE ROAD WAS SUPPPOSE TO BE WIDER. THE CONTRACTOR DID NOT DOO IT. THE ENGINEER DID NOT CATCH IT. THE CITY INSPECTOR DID NOT CATCH IT. IF THE MERGING LANE DID NOT GO RIGHT INTO THE BIKE LANE JOSE WOULD BE ALIVE TODAY. SO DON’T YOU THINK THESE OTHER PEOPLE SHOULD BE CHARGED THE SAME AS GLENDA? I THINK SO. WHO IS GETTING THE REAL SLAP ON THE WRIST? W ALL HAVE BEEN RINKING AND DRIVING, THIS IS A TRAGIC ACCIDENT. FOR BOTH SIDES OF THE FAMILYS. SHE HAS NO PRIOR DUIS OR ANY OTHER PROBLEMS. A ONE TIME THING.

    ‘JOIHN’ I am familiar with the road, if one is sober it is easy enough to figure out what is going on with the merge lane. Jose would be alive today if Glenda was SOBER, plain and simple.

    LIKE I SAID BEFORE HAS ANYONE LOOKED AT THE ROAD IN QUESTION? THIS ACCIDENT COULD OF HAPPENED WHETHER SOMEONE WAS DRINKING OR NOT. I AM NOT PART OF THE RUMSEY FAMILY. I KNOW THE ROAD AND IT HAS BEEN A ACCIDENT WAITING TO HAPPEN. GO LOOK TALK TO THE PEOPLE IN THE NIEGHBORHOOD. SEE WHAT THEY THINK.

    JOSH DO YOU KNOW OUR BOND MONEY WAS TO MAKE THE ROAD 2 LANES TO HOUGHTON. THE CITY BOUGHT THE BALOTA RANCH. THEN JOSH YOU CAN SEE THE BIKE LANE STICKS OUT BY 5′ INTO THE MERGING LANE. THE CONTRACTOR DID NOT BUILD IT TO PLAN

    I am aware that the contractor did not do the job correctly, when it comes to this case that really is a bit of a red herring. The operator of a vehicle is responsibile for the safe management of said vehicle at all times regardless of existing road conditions. Inattention or driving under the influence can make it difficult to assess road conditions.

    Oh for crying out loud John – we’ve *all* seen that spot, I live just a few miles West and traverse it on bicycle and motorcycle a couple times a month visiting friends on the far East side. Thousands of drivers a day that aren’t drunk, and are responsible enough to actually pay attention to the road don’t seem to have any trouble not killing somebody there. Why oh why is everything in our society expected to be dumbed-down to the lowest common denominator just to give irresponsible people an “out” from being held accountable for their actions?

    I agree with Josh – the fact that the contractor hasn’t finished widening the road all the way out yet is a red herring – yes this needs to be corrected, but that doesn’t excuse Rumsey or anyone else from driving drunk or driving sober-but-stupid.

    Maybe I’m just a lightweight, but a BAC of 3x the legal limit would probably kill me before I managed to crawl my way into any vehicle. Since I ride a motorcycle as my largest vehicle, and therefore need to stay extra-sharp just to stay alive, if I were to ride at even 1x the limit I doubt I would make it very far.

    Wasn’t Glenda Rumsey’s trial suppose to start Oct 14 (yesterday?). Did it get postponed to the January 09 date? There was nothing mentioned in the news. Just curious. I do hope justice prevails for the sake of Jose Rincon’s family.

    A bicylist was killed by this driver and a jury awarded the driver $350,000 damages for her trama! not the bicyclist! No wonder we have so much trouble holding car drivers accountable.

    I WOULD LIKE TO SAY MY PRAYER FOR JOSE AND HIS FAMILY. I WOULD ALSO LIKE TO FOR GLENDA AND HER FAMILY. THIS WAS A TRAGIC ACCIDENT. IT AFFECTS BOTH FAMILYS GREATLY. I KNOW GLENDA. I KNOW SHE IS LOST. RUNNING SCARED.I KNOW SHE WOULD GIVE HER LIFE TO BRING JOSE BACK. BUT SHE CAN’T. IMAGINE IT HAPPENING TO YOU. THE NIGHTMARES OF WHAT HAPPENED AND LIVING WITH IT FOREVER. KNOW THAT PRISON IS LOOMING. DON’T KNOW HOW LONG. BUT KNOWING IT WILL HAPPEN. GETTING IRRATABLE WITH LOVE ONES FIGHTING WITH THEM. BECAUSE SHE IS SCARED.     Jose Luis was a good student always number 1. Rumsey is a alcohal adict who needs help she should go to jail for at least 5-10 years. She is no better then any other person who gets drunk, Drives with a DUI, leaves a crime seen, and first degree man slaghter. I dont wish for her to go to hell or any thing but i want her to pay her price and take what she gets.

    glenda has two children and she knows the pain of loosing a child,she is geting ready to loose both of them by her going to prison. which will not bring anyone back.or give any releif to the fact that he is gone. it is sad, all around.ipersonally think she should have a mandatory rehab sentenceand be confined to to a recovery institute for atleast a year. isee no purpose in a jail term. if she was not intoxicatedwhen this traggic accident occured then she probaly would not be faceing all thisahead to come. its clear that kids wil take chaces and riding on a bikelane that leads into the highway is not tatally her fault. ther was negelence o several parts morethan one. clearly a bike path that leads into a busy highway is a accident waiting to happen. not to mention that the poor boydidnot have the proper atire for riding at night.if this was turned around and he rode into the path of a vehicle and caused a fatal accident involing the driver of a vehicle he would be at blame.i bet the highway will be fixed now that someone finnallyhas gotten killed. like most things . noone reacts to a dangerous problem til its to late. my simpathys to all involved..

    I thought that the testimony and evidence presented showed that they *weren’t* in the bike lane because they though it was too dangerous – they were way off the road on the shoulder and far enough past the 2-into-1 lane bottleneck as to not be explained away as just her missing the merge. Maybe I’ve gotten the wrong information, but as I understand it, she had to have been obliviously cruising along in the dirt shoulder to hit those kids. Not sure how that becomes shared negligence.

    I blame the system for releasing her. Not her her mother died when she was abou 8 and dad was an alcoholic. It is no excuse for her behavior she is the type that will be scared straight and follow AA she didn’t see this coming would you. I drive at night straight and teens are way out on the street with no white shirt or bright colors on at least thats what I was taught in drivers Ed they should wear. It is scary for all drinking or not. Why are there parking lots at bars by the way is that right to ALLOW people to drink and drive how disgusting our world is getting.. I pray for her and Jose’s family.

    I DAM NEAR HIT SOME ONE OUT IN THE SAME SPOT IN LATE 2007..I WAS SOBER…I WAS PISSED @ THE WAY THE ROAD WAS DONE…WHEN YOU GET YOUR FIRST BIKE..WHAT ARE YOU TOLD BY YOUR PARENTS…STAY OUT OF THE STREET……TUCSON..YOUR BS BIKE PATHS ARE A LAWSUIT..WAITING TO HAPPEN..MOTOR CYCLE DONT GET ALONG WITH CARS OR TRUCKS..THIS IS A KNOWN FACT…WHY WOULD YOU WANT TO UP THE ANTE WITH BICYCLES…..BS………
