Tucson cyclists beware: Tucson Police Department defends its policy not to cite motorists who injure cyclists in "right hook" accidents
The Tucson Police Department has exonerated an officer who failed to cite a driver in a “right hook” accident that sent a local bike commuter to the hospital.
The cyclist was lawfully riding on Tucson Boulevard when she was hit by a taxi that made a right turn into her. A witness described the driver as making a sudden turn, without using a turn signal, directly into the rider. The cyclist was thrown over the vehicle and landed in the street, with injuries.
The driver was not cited. According to the cyclist, the officer said he was not present at the accident and thus could not determine fault.
The complaint has been closed and the officer was exonerated of any misjudgment. The exoneration letter, dated February 12, 2008, states that the officer’s actions were “consistent with Tucson Police Department General Orders and were appropriate in this situation.”
It also states that “the Tucson Police Department is committed to providing excellent service to the community. We appreciate this opportunity to examine the service provided to you.”
The letter is signed by Richard Miranda, the Chief of Police.
